Misdemeanor Division
Misdemeanor attorneys in the Taylor County Criminal District Attorney's Office prosecute all Class A and B misdemeanors filed in Taylor County and handle Class C appeals from Municipal and Justice of the Peace courts. The Misdemeanor Division handles over 3,000 cases per year.
Class A misdemeanor offenses are punishable by a fine of up to $4,000, incarceration in the county jail for up to one year, or both such fine and incarceration. Sentences for Class A misdemeanors can be probated for up to two years. Examples of Class A misdemeanors include Assault with Bodily Injury on a Family Member, Possession of a Controlled Substance, and Theft from $750 to $2,500.
Class B misdemeanor offenses, such as Driving While Intoxicated First Offense and Theft from $100 - $750, are punishable by a fine of up to $2,000, incarceration in the county jail for up to 180 days, or both such fine and incarceration. Sentences for Class B misdemeanors can also be probated for up to two years.
There are two County Courts at Law in Taylor County. One misdemeanor prosecutor is assigned to each court. These prosecutors are assisted by a team of support staff and investigators. Much of the prosecutors' time is spent in court for docket call, pre-trial hearings, pleas before the court, probation revocations, trial, and post-trial hearings. When the attorneys and investigators are not in the courtroom, they spend their time reviewing and preparing cases, which includes locating witnesses, interviewing witnesses, and reviewing evidence. Our misdemeanor prosecutors follow the highest ethical standards to properly evaluate and try criminal cases to ensure justice is done.
