Pre-Trial Diversion

Pre-Trial Diversion’s (PTD) are granted on a case by case basis at the discretion of the Taylor County District Attorney’s office. The program is seen as an alternative to prosecution which may divert certain first time misdemeanor offenders and certain felony offenders (up to a 3rd degree felony charge) from traditional criminal justice processing into a program of supervision and rehabilitative services overseen by the Taylor County Community Supervision and Corrections Department.

In criminal matters Pre-Trial Diversion is a way to both rehabilitate offenders while allowing cases to be disposed without court intervention, giving the court more time to concentrate on the growing number of criminal offenses in need of prosecution.

Upon successful admission into the program, an offender is required to accept responsibility for his or her conduct, work within the probation department’s guidelines in an effort to deter any further criminal misconduct with a goal of educating and assisting the offender in making better life choices.

After obtaining the participant’s full compliance and cooperation through the entire program the participant’s case may be dismissed through the court after one year; however, if the participant commits a violation of the agreement within that year, the Taylor County CSCD or the Taylor County District Attorney’s Office may seek to extend the program to the maximum of two years or dismiss that person from the program entirely, depending on the severity of the violation. Dismissal from the program without successful completion will subject the offender to prosecution and conviction for the offense charged.
